Essential VDP Additional Terms
PLEASE READ THESE TERMS CAREFULLY.
These Essential VDP Additional Terms (“Additional Terms”) highlight the specific terms and conditions applicable to Customer’s use of HackerOne’s Essential VDP Service (“Essential VDP”). In addition to these Additional Terms, Customer’s use of Essential VDP is subject to the Essential VDP Product Documentation, the HackerOne General Terms and Conditions and the HackerOne Customer Terms and Conditions (collectively, the “Terms”); these Additional Terms form part of the HackerOne Customer Terms and Conditions and are hereby incorporated therein. Defined terms not defined herein are defined in the Terms.
To the extent Customer uses Essential VDP, these Additional Terms apply to, and only to, Customer’s use of Essential VDP regardless of any other Service(s) Customer may use. In the event of any conflict between these Additional Terms and the Terms, these Essential VDP Additional Terms will control to the extent of such conflict.
1. Essential VDP Fees
Essential VDP is a free Service. There are no Fees associated with Customer’s use of Essential VDP.
Although HackerOne does not charge Fees for the use of Essential VDP, there may be Fees associated with any additional Service(s) Customer may use or purchase. If Customer uses Essential VDP, HackerOne will make Essential VDP available to Customer free of charge until the earlier of (a) the date on which Customer’s Essential VDP is terminated or (b) the start date of a paid Service that replaces Essential VDP.
2. Limits; Customer Responsibilities
Customer agrees to not use Essential VDP in any manner that substantially exceeds expected use, as solely determined by HackerOne, including but not limited to storage and bandwidth consumption.
HackerOne may change the limits that apply to Customer’s use of Essential VDP at any time in HackerOne’s sole discretion without notice to Customer, regardless of whether or not Essential VDP is used in conjunction with other Service(s) for which Customer pays HackerOne a fee.
Customer agrees that it will use Essential VDP in compliance with the Essential VDP documentation. Customer acknowledges and agrees that the suitability of Essential VDP may vary based on Customer’s circumstances and that Customer is solely responsible for its use, interpretation, and application of Essential VDP, including any determination that Essential VDP satisfies Customer's applicable legal and regulatory obligations.
3. Modifications; Termination
HackerOne may make changes to Essential VDP that materially reduce the functionality provided to Customer at any time at HackerOne’s sole discretion, up to and including discontinuation of Essential VDP.
Customer agrees that any termination of Customer’s access to Essential VDP may be without prior notice, and Customer agrees that HackerOne will not be liable to Customer or any third party for such termination. Customer is solely responsible for exporting Customer Data from Essential VDP prior to termination of Customer’s access to Essential VDP for any reason, provided that if HackerOne terminates Customer’s account, except as required by law, HackerOne will endeavor to provide Customer a reasonable opportunity to retrieve its Customer Data.
4. Data, Privacy & Information Security
Customer’s use of Essential VDP, and any Customer Data uploaded thereto, is subject to HackerOne’s Privacy Policy and HackerOne’s Data & Information Security Policy.
5. DISCLAIMER; LIMITATION OF LIABILITY
Notwithstanding any provision of the Terms to the contrary (including Section 9.1 of the Customer Terms and Conditions), HackerOne makes no warranties that Customer’s use of Essential VDP will meet Customer’s specific requirements or be available on an uninterrupted, secure, or error-free basis. EXCEPT AS EXPRESSLY SET FORTH HEREIN, ESSENTIAL VDP IS PROVIDED “AS IS” AND “AS AVAILABLE” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES IMPLIED BY ANY COURSE OF PERFORMANCE, USAGE OF TRADE, OR COURSE OF DEALING, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. NOTWITHSTANDING ANYTHING IN THE TERMS TO THE CONTRARY (INCLUDING SECTION 10.2 OF THE GENERAL TERMS AND CONDITIONS) AND TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL HACKERONE'S TOTAL LIABILITY IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE ARISING OUT OF OR IN CONNECTION WITH THE TERMS OR FROM THE USE OF OR INABILITY TO USE ESSENTIAL VDP EXCEED $1,000.
6. Updates
HackerOne may update these Additional Terms from time to time by posting a revised copy on this page, so please check this page regularly. If Customer continues to use Essential VDP after HackerOne has modified the Additional Terms, Customer will be deemed to have agreed to be bound by the modified Additional Terms. If Customer does not wish to accept the updated Additional Terms, then Customer must stop using Essential VDP.
